1.Nature of services

Nexgen Marketing Solution provides digital business services including but not limited to:

• Lead generation
• CRM automation
• Advertising campaign management
• Business consulting
• Funnel building
• Payment integration support
• Business funding connections with partner lenders
• POS machines and payment processing services

We reserve the right to modify, suspend, or discontinue any service at our sole discretion.

2.Funding connection services

Nexgen Marketing Solution does not lend directly. We only help businesses obtain funding and do not accept personal loan applications. When you submit an application, we review it and send it to a suitable partner lender.

By using this service, you understand and agree that:

• Approval, amount, cost, term, and all other conditions of any funding are decided by the lender, under the agreement you sign directly with the lender
• The lender may run a soft credit check, which does not affect your credit score
• You confirm that the information and documents in your application are accurate and complete, and that you have the right to provide the business’s and the owners’ information
• We may contact you for additional documents the lender requests

3.Account

You sign in to the Website with your Google account. You are responsible for keeping your Google account secure and for the activity that takes place under that account.

We reserve the right to suspend or close an account if we detect false information, fraud, or a violation of these Terms.

4.No professional guarantee

You acknowledge that:

• Marketing results vary
• Business performance depends on multiple external factors
• We do not guarantee specific income, leads, or ROI
• We do not guarantee that a funding application will be approved, or approved for a specific amount or on specific terms
• Preliminary bank statement check results on the Website are for reference only and are not an approval decision

All services are provided on an “as-is” and “as-available” basis.

5.Payments & billing

If you purchase services:

• All fees must be paid in full as agreed
• Payments are non-refundable unless otherwise stated in writing
• Late payments may result in suspension of services
• You are responsible for applicable taxes

If third-party payment processors are used, their separate terms apply.

6.User obligations

You agree:

• To provide accurate and truthful information
• Not to use services for unlawful purposes
• Not to attempt unauthorized access to our systems
• Not to misuse advertising platforms or automation tools

Violation may result in immediate termination without refund.

7.Intellectual property

• Branding
• Logos
• Designs
• Software

are owned by Nexgen Marketing Solution and protected under international intellectual property laws.

You may not copy, reproduce, or distribute any content without written permission.

8.Third-party platforms

Our services may integrate with platforms such as:

We are not responsible for third-party system downtime, policy changes, or account suspensions.

9.Limitation of liability

To the maximum extent permitted by law, Nexgen Marketing Solution shall not be liable for:

• Indirect or incidental damages
• Loss of revenue or profits
• Business interruption
• Data loss
• Advertising account bans

Total liability shall not exceed the total amount paid by the client in the preceding 30 days.

10.Indemnification

You agree to indemnify and hold harmless Nexgen Marketing Solution from any claims, damages, losses, or liabilities arising from:

• Your misuse of services
• Violation of advertising policies
• Breach of these Terms

11.Data protection

Your use of our services is also governed by our Privacy Policy.

We may process and transfer data internationally depending on hosting providers and service integrations.

12.Termination

If these Terms are violated, we reserve the right to:

• Suspend or terminate services
• Refuse future service
• Remove access

13.Governing law

These Terms shall be governed by the laws of the United States of America.

Any disputes shall be resolved in the courts of that jurisdiction.

14.Force majeure
